EXCERPTS FROM THE SPECIAL CONDITIONS OF THE TRANSPORTED MERCHANDISE POLICY No. 5768749604

The provisions of the French Insurance Policy for Merchandise Transported over Land (printed on 07/11/1990, amended on 03/11/1993, 11/05/2006 and 01/01/2007) and the French Insurance Policy for Merchandise Transported by Air (printed on 25/10/1990, amended on 01/01/2007), along with these Special Conditions, constitute the insurance contract.

Definitions

POLICY HOLDER: BOXTAL

INSURED PARTY: THE BENEFICIARY OF THE BOXTAL SERVICE, SIGNATORY TO THIS SUBSCRIPTION AMENDMENT. MERCHANDISE INSURED: THE GOODS TRANSPORTED NAMED ABOVE IN THE SUBSCRIPTION FORM. START OF INSURED PARTIES' RISKS: FROM WHEN THE FIRST CARRIER TAKES CHARGE OF THE MERCHANDISE AT DEPARTURE. END OF INSURED PARTIES' RISKS: ON DELIVERY OF MERCHANDISE BY THE LAST CARRIER. (at the latest 15 days after the plane's arrival date or the provision of the merchandise by the land carrier).

INSURED VALUE: THE INVOICE VALUE OF THE MERCHANDISE AT THE DESTINATION LIMITED TO THE INSURED VALUE.

Guarantees

This contract covers material loss and damage suffered by the merchandise in transit named in the subscription form above, when it is entrusted to public merchandise carriers by land or air, under the conditions of article 2 paragraph 1 of the French Insurance Policy for Merchandise Transported by Land or under the conditions of articles 5 and 6 of the French Insurance Policy for Merchandise Transported by Air, depending on the main method of transport used.

Fees reasonably incurred in transit in order to protect the insured merchandise from material damage or loss under guarantee and to limit this damage and loss are also covered.

Excluded risks

Material damage and loss, loss of weight and quantity suffered by the insured merchandise as well as any other damage resulting from:

1) fines, confiscation, sequestration, requisition, breach of blockade, contraband, prohibited or clandestine trade, preventive seizure or other forms of seizure,
2) deliberate or inexcusable faults of the insured party or any other insurance beneficiaries, their agents, representatives or beneficiaries,
3) inherent defect in the insured merchandise, worms and vermin, influence of temperature and normal allowance for waste on the road,
4) absence, insufficiency or unsuitability of the merchandise packaging or it not being wedged or stowed properly when this is done by the insured party, their representatives or beneficiaries, as well as incorrect or unsuitable parcel markings or numbers,
5) exchange rate differences, export or import bans, obstacles to the insured party's commercial operation, delays in the dispatch or arrival of the insured merchandise,
6) storage and accommodation costs as well as any costs other than those mentioned above,
7) incorrect or insufficient instructions given to carriers or transport auxiliaries by the insured party, the shipper, the recipient, their agents, representatives or beneficiaries, as well as those resulting from work by the same people in operations to move or transport the insured merchandise, unless these are precautionary measures taken following the materialisation of a risk that is covered,
8) direct or indirect effects of explosion, heat radiation, irradiation or any other source of nuclear energy from the modification of the structure of an atom nucleus or radioactivity and the effects of radiation caused by the artificial acceleration of particles, in either their civil or military use,
9) civil or foreign war, hostilities, reprisals, torpedoes, mines and any other weapons of war and in general, any accidents and consequences of war as well as acts of terrorism of a political nature or relating to war,
10) captures, arrests, seizures, enforcement orders, confinement or detention by any governments or authorities whatsoever,
11) protests, popular movements, strikes, lock-outs and other such events or piracy of a political nature or relating to war,
12) damage to reading heads and tubes, damage from a magnetic field;
13) from the hygrometric state of the atmosphere or temperature variations; slow oxidisation; mites and vermin, the non-accidental presence of dust, slow deterioration and wear, erasure, disk deterioration and non-operation of equipment
14) scratches, scuffs, dents and scrapes.
15) manufacturing faults, mechanical disturbances in machines and/or devices with a mechanism that do not directly result from a transport accident during the period of cover.
16) depreciation or reduction in value.

Excluded merchandise

1) Money, all paper, magnetic, electronic or optical means for transferring funds or payment, precious metals, goldsmithery including jewels and clocks or watches, haute couture clothes and accessories, fur, artwork, antiques, sculptures, collections, collectable items, documents or samples whose market or contractual value exceeds their intrinsic value,
2) personal effects and baggage, cars and motorbikes, rugs, mobile phones, tobacco, live animals and perishable foodstuffs or products.
3) merchandise that is classified as dangerous by the conventions, laws or regulations in force,
4) the packaging necessary for transporting insured merchandise.
