Thank you for consulting and using our website www.boxtal.com (hereinafter the Website).
The purpose of this Website is to make your access to delivery services (hereinafter the 'Services') easier by offering you transport service quotes that meet your request at the best cost, as well as by offering you the possibility of instructing BOXTAL to have the carriers (hereinafter the 'Carriers') of your choice fulfil the appropriate order or carry out any other transaction.
Please read these General Terms and Conditions of Sale and Use (hereinafter the 'General Terms and Conditions') before using the Website as any consultation of the Website and use of the transport Services offered, in particular via the API, by right entails their full acceptance as well as acceptance of the General Terms and Conditions of each of the Carriers (hereinafter the 'Specific Carrier Terms and Conditions') specific to each Service. Please read them again each time you consult and use the Website.
We reserve the right to deny access to the Website, without notice, to any User who does not comply in full with these General Terms and Conditions.
To use the Services offered on the Website by the Carriers, you must also provide us with all the information necessary for your identification and invoicing the Services you have selected. The User will ensure that this data is constantly up-to-date. This data will be forwarded to the Carriers under the User's sole liability.
By the term 'User', we mean any individual or legal entity who wishes to use the Services offered by the Carriers on the Website, in order to compare, book, order and/or purchase any Service offered by the Carriers on the Website or have these Services ordered or purchased.
By the term 'Carrier', we mean any transport operator providing the Services offered on the Website. This term includes, in particular, the postal operator, international or national shippers, urban or inter-urban courier companies, specialist express companies, collection point companies and local or regional companies.
A. Purpose and application of the general terms and conditions
These General Terms and Conditions govern the relationship between BOXTAL and the User and apply to the Services offered on the Website by the Carriers.
These General Terms and Conditions apply to Website Users in mainland France.
Services can only be ordered by Users who have acknowledged and accepted these General Terms and Conditions in full, as well as the Specific Carrier Terms and Conditions for each Service, before each order.
BOXTAL reserves the right to modify these General Terms and Conditions at any time, without notice, it being understood that these changes will not be applicable to orders that have already been accepted.
All Users will comply with the Specific Carrier Terms and Conditions, and in particular pay all amounts due and accept the conditions and limitations of liability relating to the services offered by the Website and the Services offered by Carriers on the Website.
These T&Cs are subject to the stipulations of French law No. 2004-575 of 21 June 2004 art 25-II and Order No. 2005-674 of 16 June 2005 and articles 1369-1 to 1369-2 of the French Civil Code as well as articles L121-20-4, L121-27 & L134-2, which govern contracts in electronic form.
B. User rules
To use the Website, you must, as a User, be at least 18 years old, be legally able to take out a contract and use the Website in compliance with these General Terms and Conditions.
You must be financially responsible for using the Website both on your own behalf and on behalf of third parties including minors, unless you can demonstrate fraudulent use that is not due to any fault or negligence on your part.
You also guarantee the truth and accuracy of the information you or any other person using your data on this Website has provided.
Fraudulent use of the Website ordering service or use that contravenes these General Terms and Conditions, could result in our denial, at any time and without notice, of access to the Services offered on the Website.
By using the Website, you undertake to comply with the laws and regulations in force in France and if applicable, in your country of residence.
You are informed that as the Website is limited to either putting Users and Carriers in contact or to having your orders and instructions fulfilled by Carriers according to your choices, we have no control over the content of Carrier quotes offered on the Website.
You also specifically undertake, within the framework of Website use, to:
-respect others' privacy;
-respect the intellectual property rights of third parties;
-refrain from publishing illegal messages, information or data online;
-not usurp the identity of this website's users by using their password or by any othe
II. Using the website www.boxtal.com
The purpose of the Website is to assist Users in selecting Carriers and Service quotes offered on the Website, place orders on behalf of Users and have these orders fulfilled by Carriers according to their instructions.
On the Website, the User instructs the company BOXTAL (agent) to order on their behalf the Carrier's Services that they have selected, after having accepted these General Terms and Conditions as well as the applicable Specific Carrier Terms and Conditions.
BOXTAL cannot guarantee the existence, truth or availability of any delivery quote appearing on the Website. These quotes are provided to BOXTAL under the Carriers' sole liability.
A certain quality of Service is however requested from Carriers based on a Quality Charter which the User may view on the Website. Service quality control will be provided by the reviews Users are invited to give about the quality of Services provided or their experience with the Carriers.
BOXTAL places orders with Carriers on behalf of Users and according to their instructions through the following steps:

-The Website searches for quotes from listed Carriers that match your query;
-After having selected a quote, you can choose one or more options including Ad Valorem Insurance, and enter the additional information relating in
This shipping note must be stuck onto the parcel.
The invoice for the Service that the User orders from the Carrier and that they have settled shows the amount of transport processing fees corresponding to the BOXTAL commission as well as the transport disbursement for the Service selected by the User to be recovered.
BOXTAL makes a payment on behalf of the User for the transport expenses relating to the Service selected by the User. These expenses are carried in BOXTAL's accounting in suspense accounts but for the User these represent charges from which they can deduct the sum of VAT paid to the Carrier through BOXTAL.
III. Order modification and cancellation by the user
Any order cancellation or modification is subject to prior authorisation from BOXTAL and must be made in writing. Any order cancellation by or due to the user may only be accepted if it takes place at least one day before the date shown on the shipping note on which your shipment is due to be collected.
Should the order have been paid on the Website via credit/debit card or Paypal, if cancellation takes place less than 48 hours after the date and time of payment, the order will be refunded in full. If cancellation takes place more than 48 hours after the date and time the service is paid for, the order will be refunded, except for cancellation fees, and potentially fees invoiced by the Carrier chosen in accordance with the Specific Terms and Conditions.
Should the order have been paid for by bank transfer, the order will be refunded except for the cancellation fees and irrespective of the date on which cancellation takes place. Furthermore, fees invoiced by the Carrier chosen in accordance with the Specific Terms and Conditions may be retained.
The cancellation fee is €5 excl. tax.
No cancellation will be accepted for any order whose delivery is already under way.
Any change to any part of the order is possible, on the condition that the Carrier agrees. Should modification require order cancellation, this cancellation will result in the cancellation costs described above.
Should the order have been paid for, either partially or in full with the credit, the refund for the sum paid with the credit will be paid according to the terms described above, by credit to the Customer's account (i.e. the credit account will be re-credited), and can under no circumstances give rise to a refund by bank transfer.
IV. Transport and delivery
The Shipper mentioned in the order form, under the User's sole liability, must, depending on the option chosen, either wait for the Carrier selected at their home or company, or go to the collection point, post office or Carrier branch, or any other locations specified and offered by the Website to drop off their shipment with the shipping note received by email. The shipping note certifies that the User has paid for the delivery service. If the Shipper does not use the shipping note sent by BOXTAL, the Carrier will then invoice the Shipper directly for the service again.
You will be refunded for the transport service initially paid for on the Website, except for the cancellation fee defined in article III of this text. The invoice issued by the Carrier will be payable to the carrier without BOXTAL being able to intervene in any way to cancel it, which you now accept.
It is your sole and entire responsibility to correctly and exhaustively enter true and accurate information that will enable the Carrier selected to provide and fulfil the Services ordered on the Website.
In particular, it is your sole responsibility as the User to follow the three rules below, i.e. to ensure:
-That the dimensions and weight of your shipment are true and accurate. Otherwise, the Carrier may refuse to pick up your shipment, at its sole discretion. Your shipment may also be blocked in the warehouse or Carrier's branch
-That your shipment's content is authorised and that the packaging makes the content secure. Your shipment must be well packaged in order to ensure risk-free handling and moving to keep it intact, but also for safety
-That that the shipping and destination addresses are precise and accurate. If the Carrier cannot access the addresses shown due to a lack of information, the Carrier may consider that the delivery service has been carried out. V
N.B.! If you select 'Business address' for the departure address or the arrival address on the screen 1 (homepage) form, the address must, without fail, meet the two following conditions:
a. Availability condition: there must be at least one person permanently present during usual office opening hours, either at reception, or immediately available to entrust or receive a shipment.
b. Accessibility condition: access must be easily identifiable (presence of a plaque, logo or professional sign), so that there is absolutely no ambiguity about the pick-up or delivery location. Buildings which mainly house private individuals are considered to be residential addresses.
If these rules are not followed, you are liable for a failed pick-up or delivery and/or to pay an extra charge and/or to collect the shipment at your own expense with no refund for the service initially paid for.
For shipments abroad, the information about Carrier Service delivery times includes average customs clearance times. BOXTAL cannot be held liable for any delays due to longer time spent in customs.
For a Service with a guaranteed delivery time, only the transport disbursement for the Service selected by the User will be refunded by BOXTAL, in accordance with the Specific Terms and Conditions of the Carrier selected by the User. The transport processing fees corresponding to the BOXTAL commission will not be refunded.
V. Proof of order
You are explicitly informed that, unless BOXTAL makes a demonstrable error, the data you have provided in using the Website which is stored in BOXTAL or the carriers' information system has probative value with respect to orders placed.
You may be held liable if the information you have entered, in particular shipping and delivery address information, is incorrect or false and does not enable the Carrier to perform the Delivery Service.
This data stored on a computer or electronic device by BOXTAL constitutes evidence. If it is produced as evidence by BOXTAL in any legal proceeding or other, it will be admissible and binding between the parties under the same conditions and with the same probative value as any other document drawn up, received or stored in writing.
Any purchase order signed by the User by 'double-clicking' on the terms of these General Terms and Conditions signifies irrevocable acceptance that can only be questioned within the limits stipulated in these General Terms and Conditions.
'Double-clicking' with the authentication and non-repudiation procedure and protection of message integrity constitutes an electronic signature. This electronic signature has the same value between the parties as a written signature.
VI. Right to withdraw
You are informed that, in application of article L. 121-20-4 of the French consumer code, not all the Services offered by Carriers on the Website are subject to application of the right to withdraw provided for in articles L. 121-20 et seq. of the French consumer code in terms of remote sales.
The Services ordered on the Website are therefore exclusively subject to the cancellation and modification conditions stipulated in these General Terms and Conditions and/or in the applicable Specific Terms and Conditions.
VII. Method of payment for services offered on the website on behalf of carriers
The description of Services offered by Carriers on the Website specifies, for each of the Services, the options included in the price. The prices of services shown with the phrase "incl. tax" include all related taxes, fees and service costs. The service costs and fees correspond to the costs relating to the Services ordered by the User, borne by Carriers, in particular indirect taxes (VAT and other similar taxes) and the other fees necessary for processing Users' orders.
In general, unless stated otherwise, any service not explicitly mentioned in the order confirmation is not included in the prices. In particular, for shipments abroad, fees and taxes relating to customs clearance procedures are not included in the price of the Services presented, or any fees invoiced by those in charge of customs clearance. It is your responsibility to ensure that the Recipient of the shipment can pay the customs fees on arrival, failing which delivery may be delayed, or the shipment may be returned at your expense.
The prices of Services offered by Carriers shown on the Website may, at the Carriers' request, be modified at any time, without notice. These changes will be applicable immediately, but will not affect services already paid for.
B. Payment methods
1 - Immediate payment methods available for all customers.
Payment is accepted by bank transfer, Paypal account or bank card and is made when the order is placed: For payment by bank card, the detailed invoice is issued by BOXTAL and is paid for through the Website by the user directly with BOXTAL when the order is placed via a secure payment procedure directly from the Website by entering your bank card number.

The order is confirmed and activated on receipt of proof of the transfer and the duly filled in and signed purchase order.
2 - Payment methods available for customers who have created a BOXTAL account.
The immediate payment methods are available for customers who have created a BOXTAL account. In addition, account customers have several deferred payment methods available to them: payment is accepted by bank transfer or direct debit from a bank account. BOXTAL issues an invoice every 15 days and each invoice must be paid on receipt. These payment methods are activated on request to BOXTAL from the My Profile page.
For payment by direct debit from a bank account, the direct debit authorisation request, with your bank details, must be printed, duly filled in and signed and sent to:

BOXTAL will send these documents to your bank to request a direct debit from your bank account. Payment by direct debit will only be activated and confirmed on receipt of your direct debit authorisation.
For payment by bank transfer, this must be made to the following account:

Should payment be irregular, incomplete or non-existent for a reason attributable to You, the sale of these services will be cancelled and you will be liable for these costs. Civil or and/or criminal proceedings could also be led against you. We also reserve the right, at our sole discretion and without notice, to deactivate your BOXTAL account.
The invoice for the Service that the User orders from the Carrier and which they must pay includes the sum of transport processing fees corresponding to BOXTAL's commission as well as the disbursement for transport relating to the Service selected by the User to be recovered, and shows them separately.
BOXTAL makes a payment on behalf of the User for the transport expenses relating to the Service selected by the User. These expenses are carried in BOXTAL's accounting in suspense accounts but for the User these represent charges from which they may deduct the sum of VAT paid to the Carrier through BOXTAL.
The detailed invoice is issued by BOXTAL and it is paid by the user through the Website directly to BOXTAL when the order is placed, or by deferral using one of the payment methods described above.
Invoices issued by BOXTAL can be paid in Euros on receipt. BOXTAL, however, reserves the right to request payment when the order is placed from any person who does not provide a sufficient guarantee and/or who has not met the payment deadline mentioned above for services carried out during the year and/or previous years, without prior notice.
BOXTAL only considers the sums due to have been paid when these sums are received – presenting a transfer order will not be considered as payment. For payment by draft, this must reach BOXTAL signed, accepted and domiciled within a maximum of 10 days of the invoice date.
Any delay in payment makes all the outstandings due to us payable immediately. It will also give rise to the application of late penalties at a rate equal to three times the legal interest rate in force. These penalties will be applied from the day after the due date until the date of final payment. Without prejudice to our other rights, we will also have the option of suspending execution of all transport orders in progress. As a penalty clause and after giving prior notice by registered letter with acknowledgement of receipt, BOXTAL also reserves the right to increase the total amount of sums due excluding tax by 15%, in additional to legal interest. Instructing a third party to settle payment for our services does not in any way release you from liability to BOXTAL.
Opening a BOXTAL account triggers the creation of a credit account with a balance of 0 by default. The credit account is filled with credits in € that are only valid for the purchase of transport services on the Website (hereinafter 'Euro colis'), within the framework of referral, as described in article X of these General Terms and Conditions. One can pay for orders placed with an account on the Website either partially or in full with the credit account. With deferred payment, the amount in the credit account is automatically deducted from the invoice issued by BOXTAL every 15 days.
Any claim concerning the Services provided must be sent as soon as possible and at the latest 2 (two) days after the date of delivery by the selected Carrier (except for the Carrier Colissimo for Colissimo services), by registered letter with acknowledgement of receipt, to BOXTAL - 4 bd des Capucines 75009 Paris, with evidence. BOXTAL will send all claims to the Carrier, which is solely liable. Failing this, each delivery made will be considered to have been accepted without reservations and will prevent any later claim. No claim exempts you from paying for the service ordered.
Should the User have subscribed to ad valorem insurance with AXA, through BOXTAL, the incident will be assessed at AXA's sole discretion, and BOXTAL's liability may not be incurred. Users may not claim any compensation for their accident from BOXTAL, including for transport fees.

A refund will only be given on presentation of an invoice for purchase, sale or replacement (original documents) and/or the original proof of payment. Insufficient or unsuitable packaging are risks that are excluded from AXA cover.
Strictly for information purposes, without it constituting a commitment from BOXTAL or AXA, the User may read the online help accessible on the website Boxtal.com: all the information about Ad Valorem insurance. Should a claim be accepted by the Carrier, the refund for the transport disbursement relating to the Service selected remains at the Carrier's sole discretion, in compliance with the Specific Terms and Conditions of the Carrier selected by the User. The transport processing fees corresponding to BOXTAL's commission will not be refunded.
In the specific case of the Carriers Relais Colis® and Colissimo (Coliposte):
- Relais Colis®: the claim must be supported and include proof of the damage suffered. It must specify and indicate:
-The date the parcel was dispatched
-The type of complaint: lost, return not received, delivery disputed, damaged, etc.
- Colissimo (Colissimo Access and Expert): any claims for compensation must be made directly to Coliposte, according to the terms described in the carrier's T&Cs: Coliposte general terms and conditions.
Should Coliposte accept, the compensation will be paid to you within 2 weeks by Boxtal (EnvoiMoinsCher.com website). Boxtal.com Customer Service will not send compensation requests.

In the specific case of the Carrier Mondial Relay:

IX. Absence or limitation of liability
We cannot guarantee continuity of the service offered by the Website or that it will be constantly accessible, and decline any liability for this. We put to use all the means at our disposal to guarantee the reliability and confidentiality of the data on the Website, but we cannot be held either criminally or civilly liable for any breach of this confidentiality or other, irrespective of this breach (technical difficulty, hacker attack, human error, etc.).
We do not guarantee that the Website will be exempt from anomalies, errors or bugs, or that these may be corrected, or that the Website will work without interruption or failure, or that it is compatible with specific equipment or configurations.
We are under no circumstances liable for malfunctions attributable to third party software whether or not it is incorporated in the Website or supplied with it.
Under no circumstances can we be held liable in case of direct and/or indirect damage or foreseeable or unforeseeable damage resulting from use of the Website or the total or partial impossibility of accessing the Website.
Even if the greatest care is given to compiling and providing data and quotes from the listed Suppliers, this information is only given to you as an indication.
In general, we only offer the various delivery quotes provided by Carriers listed on the Website and at their sole liability. The quotes you are given are not exhaustive of all the offers available from Carriers and come from the data provided and given to BOXTAL by the listed Carriers.
The Carrier quotes offered on the Website appear under the Carriers' sole liability and the Carriers guarantee us against any claim or action by any individual or legal entity who considers themselves to be prejudiced by the publication and/or content of the quotes, and/or their fulfilment.
Should you place your order directly with the Carrier, your contract, your choice of Services offered by the Carriers on the Website and their fulfilment by the Carriers are all concluded directly with the Carriers under their sole liability.
Should your order be placed through BOXTAL, on your behalf, with the Carrier that you have selected, according to your instructions, we will do everything possible to ensure the Carrier fulfils your Order under their sole liability.
Under no circumstances may we be held liable for the choice of Carrier you have made, or for the Service offered by the Carrier.
Under no circumstances may we be held liable for errors made in the information you provide us with (your identity, the shipper's identity or any other information necessary for carrying out the Service ordered), that you send us at your sole liability.
Under no circumstances can we be held liable for failure to execute or improper execution of all or part of the services provided for by the contract, which is either attributable to you, or to the unforeseeable and insurmountable fault of a third party who is unrelated to the service, or to a case of force majeure.
Under no circumstances can our liability be incurred in respect of the Services offered on the Website, only the Carrier's liability may be sought.
BOXTAL can under no circumstances be held liable for the actual pick-up date (which may be different from the planned pick-up date), or the actual delivery date and any delay occurring. These events remain the Carrier's sole and entire responsibility. Should the service chosen have a guaranteed delivery time, this time only starts on the actual date of pick-up. If a there is a delay beyond the planned pick-up date, it is the Carrier's decision and their decision alone whether to refund the service. BOXTAL's liability may not be sought under any circumstances.
Should you have used a Collect on Delivery Service offered by the Site by a Carrier, if it is impossible for the payment beneficiary to collect, BOXTAL's liability may not be sought, irrespective of the cause. In particular, BOXTAL cannot be held liable for non-payment or fraudulent payment from the shipment recipient.
Except in case of a Website malfunction attributable to us, we cannot be held liable for anomalies that occur in the ordering, processing or printing of the shipping note that are either attributable to you, or due to the unforeseeable and insurmountable fault of a third party unrelated to the service or a case of force majeure.
X. Promotional mechanisms
A. Special operations/promotions
BOXTAL may decide, at its sole discretion and under conditions that BOXTAL will define, to organise special and/or promotional operations concerning one or more Carriers.
These offers may be aimed at Users who are already BOXTAL customers as part of loyalty programmes or to new Users.
The conditions for these special operations/promotions will be subject to a specific notice, detailing the conditions of the offer and access to Users.
Any Users (existing BOXTAL or new customers) who do not meet the offer criteria cannot claim any compensation of any kind whatsoever.
The referral scheme in place on the Website enables any customer who has created a BOXTAL account to earn Euros colis. Euros colis are credits that can be used exclusively on the Website, only to purchase transport services. Euros colis are attributed by BOXTAL according to the rules described on the Website. Euros colis are valid for one year from the date they are obtained. The validity period of Euros colis is automatically extended by one year as soon as the BOXTAL account holder places an order on the Website, using the Euros colis available in their credit account. BOXTAL reserves the right to modify the validity period of Euros colis unilaterally, at its sole discretion.
Should BOXTAL suspect fraudulent use of the referral scheme, or should BOXTAL block use of a User's BOXTAL account, BOXTAL reserves the right to set the balance of Euros colis contained in the credit account to zero, at its sole discretion, with no obligation to give notice to the user who holds the BOXTAL account.
Under no circumstances may the Euros colis available in a User's credit account give rise to a refund by bank transfer.
Within the framework of referral, the referrer is a customer with an account who has placed at least one order on the website Boxtal.com. The referrer may invite their contacts to join Boxtal.com. But no person who is already a BOXTAL customer can be referred: these contacts must always be new customers.
We reserve the right to correct any errors on the Website, as soon as we are made aware of them and, more generally, to modify all or part of the Website or its content at any time and without notice, without our liability being incurred.

We apply the obligations and provisions of the amended law 78-17 of 6 January 1978 (in particular by the law of 6 August 2004) referred to as the French 'data protection law' and its orders.
